| What is a Tax Sale?
In Ontario, a tax sale occurs when a property owner fails to pay municipal property taxes for an extended period. The municipality may eventually sell the property to recover the outstanding tax debt. This process is governed by the Municipal Act, 2001, and serves as a last resort for municipalities to collect unpaid taxes. It does not mean the property is being sold by the owner voluntarily.
Minimum Bid Price
The minimum bid, often called the “tax sale price,” typically starts at the amount of the outstanding taxes plus costs. However, the actual opening bid can vary. Bidders should understand that the minimum bid covers the tax arrears but does not guarantee clear title or absence of other liens. Always verify the exact minimum bid from official municipal notices.
Due Diligence
Before bidding, thorough due diligence is essential. This includes reviewing the property’s legal description, checking for environmental issues, zoning compliance, and any other encumbrances. Prospective bidders should obtain a current survey, title search, and inspect the property if possible. Municipalities provide limited information, so independent research is critical.
Bidding Process
Tax sales in Ontario are usually conducted by public auction, either in person or online. Bidders must register in advance and may need to provide a deposit. The auction follows specific rules set by the municipality. The highest bidder who meets or exceeds the minimum bid wins, but payment must be completed promptly according to the terms. Failure to pay can result in forfeiture of the deposit.
Risks
Tax sales carry significant risks. The property may have undisclosed liens, environmental contamination, or structural issues. There is no warranty of title or condition. The previous owner may have redemption rights in some cases. Market conditions can change, and the property may require substantial investment to become habitable or rentable. Bidders should only participate with funds they can afford to lose.
